In life there are a lot of things we learn by accident, which can be very beneficial to us. Sometimes understanding these processes can take a while. Sometimes after proper explanation ...Blam, you get it. That is exactly what happened to me. When I first heard about the topic, I will discuss in this E-book, it was perplexing, however, I knew that it could reap huge rewards in the future. It took a while for me to understand the process. I remember trying to tell a buddy who owned an apartment building about _________ and what it could do for him. I remember getting it all confused (like telling man a good joke, but while you are trying to say the good joke, in mid sentence you realize that you don't remember it all and it is not arrival out right, so you just say forget it because you are screwing the joke up). Fortunately, by mistake I came across the business Pensco Trust who has educated me on this great opportunity of____________. I am considered one of their "Preferred Professionals." My learning curve is your benefit. enough with my teasing games, the purpose of this E-book, is to educate you on Self Directed Iras. So buckle up!

We all know that communal safety (Ss) is struggling and the money there will ultimately disappear. Prior to 1935 there was no personal Ss. All that existed were population saving their money in their bank/under the mattress. In 1935 Ss was created. Remember that this was the same time period of the Great Depression. Now on the flip let's say there was no problem with Ss. Have you ever talked to man who gets Ss checks? They don't get a lot of money. It is sad sometimes. I am not trying to offend anyone, but the majority of the older population you see at Wal-Mart greeting you and marking your receipt didn't have a "nest egg" to rely on when they "retired". The topic I will discuss will preclude that from ever happening to you and I.

1974 congress created Ira (Individual retirement Account) to supplement communal Security. We know these are programs to help protection money away for tax benefits. Typically population go after the primary investments. We all the time hear about stocks, bonds and Cd's. Yes all investments have risks, but the thing about these investments is that you can not affect the outcome of the business/your return. You are a spectator, watching the game. Also, you can't use leverage (an example of using leveraged will be discussed later). Also, with stocks if any wee blip in market occurs, like oil, war, scandal, etc. Your value could go down. Real estate does go up and down but commonly you don't lose all of your money in worst case scenarios. Real estate appreciation has kept pace or exceeded inflation. It is a cycle. When it goes down, the value does not go down right away (like Enron).

Self Directed Ira (Sdi) an overview. Now I am not bashing stocks, I have them, if you talk to any financial planner, they will tell you to all the time be diversified in your investments. This is what Sdi does for you. Ideally you should have Sdi, stocks, bonds etc.

Sdi has been a well kept secret. Why? I think it is because of ignorance, and I also the folks on Wall road don't benefit. A broker at an investment business will not tell a man about it, because they can't make money off of the transaction (let alone having them understand how it works). The last fancy is because there are "professionals" who don't have a clear understanding on its use.

To get a Sdi, you would either have to go straight through an Administrator, or a Custodian.
What is an Administrator? Banks, brokerage firms (like Charles Schwab) and insured prestige unions.

What Is A Custodian?
There are very few self-directed Ira/401k custodians in the United States. In order to be a custodian for self-directed products, the custodian is known as a "passive custodian." This plainly means that they are obligated by law to contribute only custodial and administrative services for the marvelous plan. They can contribute No investment advice. This tremendously reduces the fees connected with primary investments because you, the investor, make all of the investment decisions. They are also Fdic insured.

What is the role of the custodian

o Holds your Ira assets

o Performs all Ira transactions

o Keeps all Ira records

o Provides all Irs required reports

o Keeps Ira plan in compliance

o Provides entrance online access

There are only three things your Sdi can't invest in and they are

o Collectibles/antiques

o Life insurance

o Stock of a sub-chapter "S" corporation (these are companies that are traded publicly on the stock market)

As long as the transaction is for investment purposes and you have not created a "prohibited transaction" (will discuss later) the list of investments are endless.

The beginning of a long list of real estate you can buy with your Sdi

o Foreclosures, Options, Pre-construction, raw land, apartments, offices, strip malls, mobile homes, communal storage, any type of investment property

o Trust deeds/mortgage notes

o Privately held C-Corp stock, Llc membership

The rules on prohibited transactions

o Cant buy from or sell to a disqualified/prohibited person

o Cant make personal use of property

o Cant use Sdi as collateral for personal loan

Personal use prohibitions

You can't personally use a vacation home. Even if you rent it out for 354 days and spend one day in it, this is illegal. You can't achieve maintenance on the property. You can hire a maintenance crew using the money arrival out of your Sdi, but you can't physically work on the property. You also can't hunt on raw land, dock boat at a Sdi owned boat slip. There was a person, who worked with Pensco, that bought a specific area of a water fishing spot in Alaska. The person, couldn't fish there, so she leased out the area to other fishermen and received profit.

More on disqualified persons

You can't buy from a man providing services to the investment. It has to be a clean slate. It can't be business between manager and employee. If you have your Sdi in an Llc and you want to buy property, you will not be able to if you own more than 50% of the company. You can't buy/sell to a member of your family including spouse, ancestor, lineal descendant and any spouse of a lineal descendant. Meaning, not you parents, children, your son in law etc. But, you can buy/sell to a sibling. There can't be a sale/exchange/leasing of any property or providing a loan between a plan and a disqualified person. Lastly, you can't buy something you already own (Sdi can't be used for funds to pay off your mortgage. There should be no perceived direct or indirect personal benefit to the account owner).

Basic rules

o Can't involve the account holder, his/her spouse a lineal ascendant/descendant of family nor the spouses of your children and you can't use Sdi funds to pay off a personal mortgage

o Can't make personal use of property (must be for investment purposes only)

o Can't personally warrant the loan for your Sdi nor use the Sdi as collateral for a personal loan

o Can't work for or take earnings from an Sdi investment

o Can't have your spouse, nor your family members (your siblings are ok) own the property prior to its buy by your plan

o Can't have your business lease or be located in or on any part of the property while it's in your plan. You may receive any property as a distribution from your plan as a retirement benefit

What transactions are prohibited?

The following are defined as prohibited transactions when they involve the account holder:

o Borrowing money from the Sdi

o Selling property to the Sdi

o Receiving unreasonable payment for managing assets for the Sdi

o Using the Sdi as safety for a loan

o Buying property for personal use with the Sdi

o Collectibles/antiques

o Life insurance

o Stock of a sub-chapter "S" corporation

50% rule

If a disqualified person(s) owns 50% or more collectively of an entity, then the Sdi can't engage in a transaction with the entity because the business is considered a disqualified person.

Using Ira as collateral

You can't use your Sdi as collateral for a loan. If you will get a loan it must be an unsecured loan. If you default in paying the loan, the lender can't go get the money out of your Ira, nor can they go after personal assets.

Any type of prohibitions have penalties, if you violate them. Sdi is no different. Here are the consequences if you do not comply:

o Loss of Ira status resulting from prohibited transaction

o Loss of tax exempt status

o Income tax on account value

o Penalties and interest

o Possible audit to settle extent of prohibited transactions

Ways to invest by using your Sdi

o Property buy all cash

o Property buy using a loan (Note this has not all the time been the case where you can get a loan from a bank for your Sdi. These past consolidate of years a few establishments are gift loans to Sdi. I have those contacts, feel me and I will scrutinize options for you)

o As a member of an Llc or "C" Corp.

o As a lender on a trust deed (mortgage note)

o As a partner in a joint venture

o As a Tenants in tasteless T.I.C. Member (if any of the terms I use are unfamiliar to you, look them up online)

o Make a incommunicable loan to an entity or man (hard money loans)

Pensco's top investor success story is going to amaze you on the possible your Sdi can have. In March of 1999, four men opened up Sdi accounts. They each invested individually and straight through their Ira's in a business they were starting. They brought in other unrelated investors. That business is bought out a consolidate of times. How it works

You have an account with Pensco (you can roll over your current Ira account to them) you tell them what you want to invest in, they do all of the paper work, make out the check and now it is in your trust account. All money that is needed for expenses and all profits go into/taken out from the trust account. The title of the property in your Ira will be held with Pensco Trust as follows: "Pensco Trust Custodian, Fbo (client name) Ira, (Acct #). All documents will be reviewed and initiated by the you (the Ira owner) and signed by Pensco Trust.

Introducing Sdi on steroids in the neck...Solo 401(k)

A solo (k) is a combined wage deferral and profit sharing retirement plan for sole proprietors, small business owners with no employees (other than part timers working less than 1,000 hours per year or their spouses).

Roth contributions can growth tax free ,000 to %20,500 per year or 30k to 41k per married consolidate (for 2007). Unlike a Roth Ira, there are no earnings limitations located on the contributor. Types of purchases of Sdi

All cash

Your Sdi buys one property all cash. No debt, Llc, and partners. When you do this your Sdi needs to have enough funds to cover buy price, all windup costs, custodial fees and ongoing property expenses. If you run out, you can loan your personal money to your Sdi (with interest and principal).

Multiple Sdi - All cash T.I.C.

Sdi may belong to anything - even prohibited people. All Sdi go on contract, and on title, as "tenants in common." proprietary percentage must be identified and all costs and proceeds prorated correctly agreeing to these percentages.

Multiple Parties - Iras & population all cash T.I.C.

Same as manifold Iras, as long as there is no loan (as an all cash deal) it does not matter who the Sdi belongs to, or who the population are. All names must be on ageement and title for unique percentages.

All cash

Buy/sell, with/without, friends/family is by far the easiest and most tasteless transaction. When this happens all earnings comes back to Sdi, so having a1031 exchange is not required to defer taxes. The money in your trust account is also used to pay any expenses incurred. Real estate investment connected expenses are paid out of the Sdi.

Getting a loan to buy

In the past there were No banks lending to Sdi. Only until recently a few banks in the nation offer this service. The loan that is offered is a non-recourse loan. This is great news, because now investors could use leverage.

When you get a loan for your Sdi you:

o Can't warrant the loan personally.

o Can't co-invest with your Ira.

o Pay the tax on any earnings or capital gains derived from leverage.

o Increase the returns and growth of your Sdi two to three times.

What is a "non recourse loan?"

o You are not personally liable for refund of the loan. In the event of a default/foreclosure the lender can only recover the property and your equity.

o Typically requires 30-35% down payment. If there is low cash flow or the condition of the property is bad then they may wish a larger down payment.

Non recourse loan process

o After setting up the Sdi, it will typically close in 30 days.

o Cash out refinance: funds are distributed back into the Sdi.

There Is No Pre payment For A Non-Recourse Loan!

Property Eligibility

o Single family residential

o Condo's (100% complete, 33% or more sold, and Hoa turned over by developer)

o Duplexes

o 4-plexes

o Multi-family (5 or more)

o Commercial property: including retail, warehouses, and office buildings

Ineligible properties include:

o Residential with large acreage

o Raw land

o Farms

o Manufactured homes

o Hotels, condo-hotels

o Co-ops, timeshares

o Senior or assisted living facilities

o Non-franchise restaurants

o Entertainment properties

o Mini-storeage

Requirements for debt financing must be verified for buy along with reserves (10-20% loan amount).

Documentation required for loan approval:
1. Completed loan application

2. Most up-to-date asset statement verifying Ira assets for buy and reserves.

3. Purchase sales contract

4. Acceptable real estate evaluation for the property to be financed. The evaluation must come from lender.

5. Copy of drivers license

6. Property guarnatee should read the Ira/Llc as the insured

Income requirements for homes

o The financed property must originate enough net operating earnings to exceed debt assistance payments by:10%single family (less then 10% or negative cash flow is proper with enough reserves on Sfr). For 2-4 unit properties it is 10-15%

o Ira assets must be verified for buy along with reserves

How the windup process works:

1. Title business prepares windup documents.

2. Sdi owner initials for approval.

3. Originals sent to Pensco for execution by the tile business or broker.

4. Pensco signs, notarizes and returns package. They overnight and wire equilibrium of funds for closing.

5. Title business forwards recorded grant deed to Pensco.

6. Through your trust, you now own the property.

Another way to invest using Ira

This is a true story from a Pensco client. One investor wanted to buy a property in San Francisco. They buyer didn't have all of the money for a down payment. So, he approached his friend and asked about him if he was interested in earning a confident percentage return on his Ira. He agreed. So, the buyer took his part and combined it along with his friends Sdi, to buy the property. His friends Sdi issued him a second on the property. This created a "win" situation for everyone. The buyer gets the property. His friend gets a great return on his Ira (that is secured by real estate) the sales agent wins because the deal closed. The owner of the property is happy, because they sold the property. The bank, is happy because they are making a return by giving a loan. All of this is possible because the Sdi was used.

There was other person, who used his Sdi to buy pre building property. In Las Vegas, there was a developer who was forming a community. The investor approached the developer and solved a problem for them. Apparently there were some fall outs with buyers. The investor, said (paraphrasing) "I will buy any homes that fall out of escrow for a discount."

Rental property purchases

Question:

I want to buy a rental property for 0,000 can I use:

In the begging of this E-book, I expressed that using Sdi has been kept a secret. One of the reasons is because of misinformation from "professionals" is from Cpa's. Some Cpa's say not to use an Ira to invest in real estate because:

o You will lose tax benefits e.g. Depreciation (not quite)

o Using Sdi "destroys" tax deferred blend growth in Ira (wrong)

o You have to pay lowly earnings tax versus capital gains tax at the end of the line (true just like any other Ira investment)

Some Cpa view points do not take into notice the following:

o They do not address need for diversification in the retirement portfolio to hedge against other assets

o Broadly implies that even if you know that you can get better results investing in real estate straight through your Sdi you shouldn't do it

o It is Irrelevant if real estate out performs other Ira investments

o Ignores the facts that 44% of net worth in Us is in real estate

o Does not recognize that after tax yield is the primary goal of the investor

Unrelated business taxable earnings (Ubti)

If your Sdi produces earnings from action not "substantially related" to the exempt status Ubti comes into play. The purpose of Ubti was to alleviate unfair competition by exempt organizations with taxable enterprises. Basically when you show the way business and it is not passive income, you come across Ubti. further explanation; if your Sdi is going to open up a restaurant, you are going to have lowly income. The Irs feels that is fair that you pay tax on the money you make everyday. Because it is not fair for you to open up a restaurant and for man else to open up a restaurant down the street, but you don't pay tax. If it is "ordinary income" Ubti applies. If it is passive earnings Ubti does not apply, such as rent, interest and capital gain.

Unrelated Debt Financed earnings (Udfi)

Income generated by action that had debt financing. Tax is applied to that part of gain/income that is debt financed. Most "passive" investments earnings such as rents from a property are commonly excluded from taxes, but such investment earnings is going to get taxed if derived from debt financed property (Udfi). Basically, if you buy a property for 5 million. You have your Sdi, put up 2.5 million and you get a loan for the other 2.5 million. Well the gains you get from the borrowed 2.5 million from the bank will get taxed (Udfi). You will not get taxed on the part that comes out of your Sdi.

My singular purpose in this record is to express that only in Christ Jesus is there true and chronic reward and success. That in ourselves we possess nothing that can deliver to us abiding joy, peace and satisfaction, and at the end of life's journey reward us with God's approval when we stand face to face with Him at Judgment Day. Only being rightly linked with the Father straight through our Lord Jesus Christ offers the fulness of life that every Christian seeks.

As both encouragement and proof that the first and true source of Christian life and virtue comes from God rather than the Christian himself, I wish to mention the following endowments that the first century apostle expressed in the book of Ephesians, part one. I do this in the hope that it will both encourage and instruct people to look to Jesus in all things. To comprehend that it is God straight through Christ that is the initiator of every good thing in the Christian's life, both natural and spiritual. That men might comprehend that only when the eyes of our faith are set on Jesus can we ever hope to be successful in our lives and ministries. Either it is victory over sin that we seek, abiding peace and joy, a depth and quality in the relationships of our lives, success in the roles of husband or wife, as father or mother, as friend, as employer, as employee, as minister. Whatever it might be that is before us. Only an abiding relationship with Jesus, and that which He offers to the Christian can bring fulfillment and success. Amen

Our God and heavenly Father is generous in deed. How can a soul forgiven fully express the depth of gratitude for the reality of having his sins forgiven? "I am free from the guilt of every sin that I have ever committed. " This is the tasteless expression of all who have come to Jesus and by faith acceptable the absolute unblemished pardon from sin that He offers. Whereas once I was guilty and dirty, now I am not only free from the condemnation and the burden of a guilty conscience, but my heart and soul is clean before Him. For in forgiving me, He also renewed me. He made me a brand new vertebrate in Christ Jesus, and all I had to do to receive this was to turn away from the filth that I used to live in, and place my faith in Him who loved me, and died that I (and all others also) might have life.

Ephesian 1:5a Having predestinated us unto the adoption of children by Jesus Christ.
How good is that? Not only has the Eternal One forgiven me my sins against Him, but He went way beyond that and adopted me into His family where I began a brother to the Lord Jesus, and an heir with Christ of all things. Now, I encourage you brother and sister, this thought can barely begin to be industrialized in this minute article, but I advise to you that Christ possess all things, and if you will abide in Him He will make them available to you in order that you may use them and enjoy them to the end that you might be to His praise. He alone is good, and the truth is that the only presuppose we love Him at all is that He first loved us.

Ephesians 1:7a In whom we have redemption straight through His blood, the forgiveness of sins.
My life has been redeemed. That means it has been bought back from the evil one. My life, as well as the lives of all human persons belonged to Satan who took rights of them when he enticed the first man Adam to sin, thus plunging the whole human race into sin, with all its dirtiness, guiltiness and regrets. We need only to learn to listen to Him, and obey Him, and never offend Him.

"Ah, thank you Lord Jesus that You do not leave us in darkness or ignorance, but rather You grant to all who will live by the faith of Jesus, and who live in obedience to your commandments, revelation of Your someone and will. You see Lord, we could never know You, nor what is freely given to us by Yourself, except that You are willing to open the eyes of our understanding. For the world lies in darkness, and we are in the world. But because you sent- (still send) Your nearnessy into all who believe, we have light and understanding. For this I (we) praise You."

Ephesians 1:22a And God placed all things under His feet and appointed Him to be head over all for the Church....
My friend, Jesus is lord over the Church, it (we who consist of it) belongs to Him. He purchased the Church with His own blood. He is not only lord over the Church, but He is also lord over all things, and He will in permissible time return in corporal form to set up shop as King of Kings, and Lord of Lords. He will then exercise absolute control over all nations, He will rule them with "a rod of iron". Then, where will those people be that have laughed at Him, or persecuted Him, and rejected Him from being lord of their lives? My friend, I encourage you to accept the reality and certainty of the promise of the Scripture that Jesus will return and that His kingdom will fill all the earth, so that you might take permissible operation with your heart and life at this present time. For it has been appointed unto man once to die, and after that is the judgment. At that time, it will then be to late to make your changes and abide under the blessings of the reality of the Lord-ship, and Savior-ship of Christ Jesus.

A wise and godly man once said, "it is the goodness of the Lord that lead men to repentance." This truth has Actually proven true in this man's life. O'Man, Along With Yourself Bathe Your Wife

Continuing devotions are considerable if the believer is to walk rightly in the Lord. This discipline must never be forsaken. Although the reality of continual devotions needs to be practiced by both man and woman, both sexes regardless of their age need to personally apply the major components of devotion (prayer, Scripture reading, Scripture memorization and meditation, and godly fellowship) on a Continuing quarterly basis.

However, the accountability of the male head in the home (husband or father) in the "washing of the souls" of himself and his house is first-rate to that of the other members of his family. In short he is to often, and by often I mean more than just a daily duty to have house devotions. The discipline of washing his house with God's word is a thing that must be industrialized into a man's character so that he is, so to speak, a "washer". The convention of washing your house with God's word needs to be after the manner of the wisdom of the Scriptures as pointedly stated in the book of James 4:13-17. Who is a wise man and endued with knowledge among you? Let him show out of a good conversation his works with meekness of wisdom. But if ye have bitter envying and strife in your hearts, glory not, and lie not against the truth. This wisdom descendeth not from above, but is earthly, senual, devilish. For where envying and strife is, there is blurring and every evil work. But the wisdom that is from above is first pure, then peaceable, gentle, and easy to be entreated, full of mercy and good fruits, without partiality, and without hypocrisy. The male head that will ( and must) wash the souls of his house with God's word must do so without strife. Those That Are Not Bathed Will Stink

So what happens O' Man if you do not fulfill your accountability to seek the Lord and then to wash the souls of your own? What will happen? The talk to that is determined to any reasoning person. If this is not corrected it will lead to an open dislike and dishonor, which in many cases leads to out right treachery, which leads to divorce. You'll hear name calling and cursing, and telling of evil or off color jokes and stories, etc. These vises, among others are ordinarily the beginnings of the fruits of the lives of those that do not daily seek the Lord. You father, you husband, are the very gift of God to your house to see to it that your yourself, and your house members are brought continually and often to before the Lord so that both yourself and they have the very best chance to avoid the many vises of the soul, that attend those that do not seek the Lord.

These two corrupting religious influences are mentioned by me in that they are very basic and very wide spread, but there are many diversions to truth found in religion, far to many to mention here. Beyond these two common corrupting influences the next potentially harmful work on I will warn you of O'Man is the work environment that your wife goes to each day. I tell you this is to be thought about very carefully. For that environment itself washes (affects) her soul, but very often it is polluted water, leaving a film, if not a heavy face of feministic, humanistic, self centered ideas from her female companions in the work place. Or, maybe the corrupt work on of some man at the job place who either in an outright or casual manner is "hitting" on her. I warn you O'Man, do not be naïve concerning these, for these influences that I mention are very often Real, and must be faced. The next work on that I will mention is that of the extended family. Does your extended house follow after your heart-beat for the Lord, and for His truth, or do they undermine what you teach your family? I will not belabor this issue, but will simply leave to your consideration the words of the Lord Jesus from Matthew 12:30, He that is not with me is against me; and he that gathereth not with me scattereth abroad. If you have extended house that do not honor the values that you advise to lead your house into and work against you, especially if they purposely work against you, then you need to face up to this and take what ever action is considerable to protect your house members. This may be difficult and painful, but to not do it may mean the purposes of God for your house members may be greatly thwarted.

God's Kingdom In One's Heart Is Not Built Over Night

O'Man, as enlightenment comes to you from the Holy Spirit, as God's truth is opened to you and conviction to obey and follow God comes into your heart there is one very basic bit of wisdom I very greatly feel I need to impress upon you. Even, as very likely, the Holy Spirit had to deal with you over a period of time to bring you to the place of insight and willingness to submit to His prominent in regards to assorted issues, in like manner you will need to extend patience and mercy as you instruct your house and work to bring them along in the convictions of your heart. Never, never, insist on any point of wisdom or commandment of God that you yourself do not give yourself to obey. This is madness, and will drive the hearts of your house far from you. Please note my brother. In the end every soul of man must make their own personal decision to surrender to Jesus and follow the ways of God, but if you play the part of the man, as God has intended, your family's success in life and godliness is far more likely.

The application of this wisdom that we have spoken in this report will do much to prove your manhood. If you will allow the Lord to bring you along is this discipline the sculpture of your own manhood will be continually increased, but along with that your house will be given the chance they need to flourish as Christians in the world. Is this not what you want? Is this not what the Lord our God wants? I believe it is, and I believe you will agree if you are of godly heart. Amen

A few months ago I had a argument with a resident physician who had executed a contract with a hospital in Pennsylvania to start a one year fellowship in the fall. However, less than 90 days before she was set to set in motion the fellowship, the hospital "revoked" the contract citing her ten year old misdemeanor theft conviction. The hospital took this operation despite the fact (1) the resident had truthfully completed her employment application by, inter alia, accurately answering she did not have any felony convictions; and (2) the misdemeanor conviction does not have any bearing on her fellowship duties as a physician.

Last month I spoke with a banker who used to work for a national bank in California and took a promotion with the same bank in Alaska. She had worked for the bank for years in California, had passed its earlier criminal background check and had been bonded. However, within weeks of her start at her new job in Alaska, the bank "discovered" she had an eighteen year old, dismissed misdemeanor marijuana fee from Delaware. The bank proceeded to desist her because of this dismissed charge.

Beyond the travails of a random physician and banker, these anecdotal accounts reflect a persistent, farranging societal problem: How can ex-offenders overcome their criminal histories in an exertion to derive and keep employment? practically 600,000 men and women are released from incarceration annually. Additionally, every year millions of individuals charged with criminal offenses have their cases disposed of without the imposition of jail time (e.g., dismissed charges; acquittals; probation). Five other states, Hawaii, Kansas, New York, Pennsylvania and Wisconsin, prohibit this form of job discrimination in both secret and communal employment. (Additionally, a amount of municipalities, e.g., San Francisco, Ca, have restricted employers' potential to rely on criminal description information in development hiring decisions.)

For individuals with criminal histories covered by one of these anti-discrimination laws, their prospective employers cannot lawfully deny them employment based on said histories absent the existence of a "reasonable" or "direct" relationship in the middle of said history and the proposed employment. It is also worth re-emphasizing that this "relationship test" matters only in the aforementioned states which have prohibited or restricted discrimination against ex-offenders in secret and/or communal employment. As a consequence, irrespective of the nature of his or her criminal history, a similarly situated job applicant seeking work in the majority of the states would not have any possible means of direct legal redress because these of states do not prohibit this form of discrimination in the secret or communal sector.

In essence, a Pbj or a "stet" disposition places the fundamental criminal matter in abeyance for a year. If while that one year period the defendant does not commit someone else offense, then the fundamental fee is dismissed. (If, however, the defendant commits someone else offense while this probation period, the prosecutor can fee them with this second offense and seek a conviction for the first offense.) The requisite benefit with a Pbj is the defendant avoids having a conviction appear on his or her record. In conducting employment background inquiries, many fellowships only focus on convictions. The absence of a conviction can only heighten an individual's prospects of gaining prospective employment.

If (1) an personel can determine a criminal fee with a dismissal, a nolle prosequi or "nol pros" request for retrial (i.e., a request for retrial by the state attorney declining to prosecute the charge), a Pbj or stet, or similar non-conviction disposition, or (2) an personel is found guilty only of a specified nuisance crime (e.g., disturbing the peace) or a single non-violent criminal act, then he or she may subsequently request for retrial the court to have the criminal description "expunged." If a employee with this type of criminal description can successfully have his description expunged, then the state will take off reference of this criminal operation from court, police and motor car records and files.
